The terms that apply when you or your organisation use Fern Learning.

Fern Learning is run by CompasCare, a New Zealand business. By using Fern, you agree to these terms. If your organisation has a separate agreement with us, that agreement applies where it differs from these terms.
Using Fern
- Use Fern only for training and compliance purposes
- Keep your sign-in details to yourself
- Don’t upload anything unlawful or harmful, or try to access information that isn’t yours
We may suspend access if Fern is being misused.
Your information
Your organisation owns the information it puts into Fern, and can export its training records. We look after personal information as described in our privacy policy.
Our content
Fern’s courses, software and design belong to us. Your organisation can use them for as long as it has a subscription.
Subscriptions
Subscriptions are annual. Fees and any specific terms are set out in your organisation’s order or agreement with us.
Availability and liability
We work hard to keep Fern available and accurate, but we can’t promise it will always be uninterrupted or error-free. To the extent the law allows, we aren’t liable for indirect losses. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where they apply.
Changes
We may update these terms from time to time. The date at the top shows when they were last updated.
Governing law
These terms are governed by New Zealand law.
